SMS Policy

SMS Message Program

HeartCheck (operated by VerticalLife and EverPresentHeaven, a 501(c)3 non-profit) operates an SMS messaging program to send daily or weekly spiritual reflection reminders to users who opt-in. This SMS Policy describes how our SMS program works, your rights, and how to manage your preferences. 

 

 

Information We Collect

When you opt-in to receive SMS reminders, we collect:

 

•       Your mobile phone number

•       Your preferred reminder frequency (daily or weekly)

•       Your preferred time and timezone for receiving messages

•       Your SMS preferences and opt-out status

•       Your confirmation that you are 18+ years old and a US resident

 

 

 

How We Use Your Information

Your phone number is used exclusively to:

 

•       Send you requested SMS reminders about spiritual reflections

•       Send opt-in and opt-out confirmation messages

•       Respond to your SMS inquiries (HELP, INFO requests)

•       Comply with legal obligations

 

We do not share, sell, or rent your phone number to any third parties. Mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes.

 

 

 

Opt-In Process

To receive SMS reminders from HeartCheck, you must:

 

1      Navigate to Profile Settings → SMS Preferences in the HeartCheck mobile application

2      Check the "Enable SMS reminders" checkbox (unchecked by default)

3      Enter your phone number in the provided field

4      Select your reminder frequency: Daily or Weekly

5      Choose your preferred time to receive reminders

6      Read and acknowledge the SMS consent agreement

7      Confirm that you are 18+ years old and a US resident

8      Click "Save SMS Preferences"

 

After opt-in, you will receive a confirmation SMS message.

 

 

 

SMS Consent Agreement

Before enabling SMS reminders, you must explicitly acknowledge and agree to the following:

 

"I understand and agree that: By enabling SMS reminders, I am explicitly consenting to receive SMS text messages from UpHeart at my phone number. I will receive reminders at my selected frequency and time. Standard SMS rates from my carrier may apply. I can opt-out anytime through my account settings, by replying STOP, or by contacting support at Bill@VerticalLife.org or (678)833-4310. I have read the SMS Policy at https://www.verticallife.org/sms-policy and confirm I am 18+ and a US resident."

 

By checking this box, you are confirming that:

•       You are at least 18 years old

•       You are a US resident

•       You have read and understood this SMS Policy

•       You explicitly consent to receive SMS messages at the frequency and time you selected

 

 

 

Message Content

SMS messages from HeartCheck are transactional, non-marketing reminders designed to encourage your spiritual reflection practice. Messages are sent only to users who have explicitly enabled SMS in their account settings.

 

Sample Messages:

•       "Good morning! Your daily heart reflection is ready. Open UpHeart to check in with your heart today. https://spiritapp-qnsx58mt.manus.space"

•       "It's time for your weekly spiritual reflection. How is your heart this week? Open UpHeart to explore. https://spiritapp-qnsx58mt.manus.space"

•       "God wants to join you as you open your day's experiences to Him. Register your heart reflection now. https://verticallife-heartapp.manus.space"

 

 

 

Message Frequency and Timing

You control how often you receive reminders:

 

•       Daily Reminders: One SMS per day at your selected time

•       Weekly Reminders: One SMS per week at your selected time

 

You can change your frequency and preferred time anytime by going to Profile Settings → SMS Preferences in the HeartCheck app.

 

 

 

Message and Data Rates

Standard SMS rates from your mobile carrier may apply. UpHeart does not charge additional fees for SMS reminders, but your carrier's standard text message rates will be applied to your phone bill. 

 

Contact your wireless provider for details about your SMS plan and rates.

 

 

 

How to Opt-Out

You can stop receiving SMS reminders at any time using any of these three methods:

 

Method 1: In-App

9      Log into your HeartCheck account

10   Go to Profile Settings → SMS Preferences

11   Uncheck "Enable SMS reminders"

12   Click "Save"

 

Method 2: SMS Reply

Reply "STOP" to any SMS message from HeartCheck

All opt-outs are processed immediately, and you will receive a confirmation message.

Eligibility Requirements

To participate in the HeartCheck SMS reminder program, you must:

 

•       Be at least 18 years old

•       Be a resident of the United States

•       Have a valid mobile phone number capable of receiving SMS messages

 

 

 

Data Security and Privacy

Your phone number and SMS preferences are protected by:

 

•       Industry-standard encryption

•       Secure database storage

•       Restricted access controls

•       TCPA (Telephone Consumer Protection Act) compliance

Third-Party Service Provider

SMS messages are sent through Twilio, a third-party SMS service provider. Twilio acts solely as a technical service provider and does not have access to use your phone number or messaging data for marketing or promotional purposes. Twilio's privacy practices are governed by their own privacy policy, available at https://www.twilio.com/legal/privacy.

 

 

 

Compliance

This SMS program complies with all applicable laws and regulations, including:

 

•       TCPA (Telephone Consumer Protection Act)

•       GDPR (General Data Protection Regulation) - where applicable

•       CCPA (California Consumer Privacy Act) - where applicable

•       All state and federal SMS messaging regulations

 

 

 

Terms of Service - SMS Program

By opting into the HeartCheck SMS reminder program, you agree to the following terms:

 

Eligibility

You must be at least 18 years old and a resident of the United States to participate.

 

Opt-In Consent

By providing your phone number and enabling SMS reminders, you explicitly consent to receive SMS messages from HeartCheck at your selected frequency and time.

 

Message Content

SMS messages will contain spiritual reflection reminders and may include links to the HeartCheck app.

 

Frequency

Messages will be sent at your selected frequency (daily or weekly) at your preferred time.

 

Charges

Standard SMS rates apply. Check with your wireless carrier for details. HeartCheck is not responsible for carrier charges.

 

Opt-Out

You can opt-out anytime through your account settings, by replying "STOP" to any message, or by contacting support.

 

Service Changes

We reserve the right to modify or discontinue the SMS program with reasonable notice.

 

Liability

HeartCheck is not liable for any delays or failures in message delivery by your wireless carrier.

 

Updates

We may update these terms. Continued use of the SMS program constitutes acceptance of updated terms.

 

 

 

Changes to This Policy

We may update this SMS Policy periodically. We will notify you of material changes by updating the date above and posting the revised policy on our website. Your continued use of SMS reminders after changes become effective constitutes your acceptance of the updated policy.
